Terms & Conditions
1. Acceptance of Terms
By booking a rental, using our website or ICAN booking portal, signing (including electronically) a rental order, or accepting delivery of a NorthPoint container, the individual or entity requesting service ("Customer") agrees to be bound by these Terms & Conditions ("Agreement"). If Customer does not agree, Customer must not book, accept delivery of, or use a NorthPoint container.
Completing a booking online, checking an acceptance box, or electronically signing an order in ICAN constitutes Customer's valid signature and acceptance of this Agreement to the same extent as a handwritten signature, under the New Hampshire Uniform Electronic Transactions Act (RSA 294-E) and other applicable law. This Agreement has the same force and effect as a signed service agreement whether or not a physical signature is obtained.
The person booking the rental represents that they are at least 18 years of age and have the authority to bind the Customer (including any company or property owner on whose behalf the booking is made) to this Agreement.
2. Definitions
Waste Material
"Waste Material" means solid waste generated by Customer's project that does not include any Prohibited Material as defined below. Customer represents and warrants that all material placed in the container is Waste Material.
Prohibited Material
"Prohibited Material" means any hazardous, radioactive, volatile, flammable, explosive, biomedical, infectious, or toxic material, including any substance listed or characterized as hazardous by the U.S. Environmental Protection Agency or any New Hampshire state agency under the Resource Conservation and Recovery Act, as amended, or under NH RSA 149-M. Prohibited Material also includes the specific items listed in Section 8 and in NorthPoint's published What Can & Can't Go In a Dumpster guide, as updated from time to time.
3. Booking, Payment & Charge Accounts
Standard rentals are prepaid at booking by debit or credit card. Customer authorizes NorthPoint to keep that card on file and to charge it, without further authorization, for: the rental price; delivery and pickup fees; weight overages; Prohibited Material and restricted-item fees; extended rental days; access-related trip, wait-time, or dig-out fees; damage repair costs; and any other fee described in this Agreement — including charges that are identified after the rental has closed (for example, weight or contamination findings from the disposal facility received after pickup).
Approved contractors with a NorthPoint Contractor Charge Account follow separate Net-30 billing terms rather than prepayment, as described on our Charge Account page. All other terms of this Agreement, including weight, prohibited-material, and damage provisions, apply equally to Charge Account customers.
Late Payment
Any balance not paid when due accrues interest at 1.5% per month (18% per annum), or the maximum rate permitted by New Hampshire law if lower, beginning on the due date. A $100 late fee applies to any balance still unpaid 8 days after the due date.
Multi-Container Swap-Outs
When a new container is delivered to replace one already on-site (a "swap-out"), the outgoing container will not be removed, and the incoming container's rental period will not begin, until any outstanding balance on the outgoing container is paid in full. Daily rental fees continue to accrue on the outgoing container during any such delay.
Non-Payment / Collections
If Customer's card cannot be charged or a balance remains unpaid, NorthPoint may suspend service, decline to schedule pickup or further deliveries, refer the account to collections, and recover its reasonable attorneys' fees and collection costs in addition to the balance owed. NorthPoint may also report unpaid commercial accounts to applicable credit-reporting or trade-reference services.
4. Rental Period, Extensions & Overdue Containers
The rental includes 7 days as part of the standard rental price, beginning on the day of delivery. Extensions are available, scheduling permitting, at a flat rate of $5/day for any container size.
If a container has not been called in for pickup and remains on-site more than 30 days past the original scheduled pickup date without an approved extension, NorthPoint may treat the rental as overdue, charge escalating daily fees at double the standard extension rate, and/or schedule pickup without further notice and bill the account accordingly.
5. Delivery, Placement & Site Access
Customer must provide clear, accurate placement instructions at booking and keep the delivery area accessible for both drop-off and pickup.
Customer represents and warrants that the location provided for container placement, and any route reasonably necessary to reach it, is sufficient to bear the weight of the delivery vehicle and container, both empty and loaded, and that Customer has disclosed any known hazards at or near the placement location (including septic systems, leach fields, wells, buried utilities, irrigation lines, or unstable ground).
NorthPoint is not responsible for damage to pavement, sub-surface, driveways, utilities, lawns, fences, shrubbery, or other property resulting from placement, delivery, or pickup at the location Customer directs, or from a location Customer failed to accurately disclose as required above, though NorthPoint will always aim to place containers carefully. If NorthPoint is unable to complete a scheduled delivery or pickup due to blocked, obstructed, or otherwise inaccessible access (including snow, ice, parked vehicles, or locked gates) and must make a return trip, a trip fee applies. If a driver must wait on-site more than 10 minutes to complete delivery, placement, or pickup, a wait-time fee of $2 per additional minute applies. If snow, debris, or other obstruction must be cleared before a container can be placed or retrieved, a dig-out fee applies.
6. Using Your Dumpster
Once delivered, the container must remain in its original placement for the duration of the rental. Customer may not move or attempt to move the container; contact NorthPoint if relocation is needed and we will coordinate it, at Customer's expense if requested for Customer's convenience.
Load debris evenly and keep it below the fill line (level with the top of the container walls); do not load above the rim. Overloaded containers may require an on-site adjustment before pickup and may carry an overload fee plus a per-day fee until the container is ready for safe pickup.
Customer is solely responsible for all material placed in the container regardless of who placed it, including material placed by third parties, subcontractors, neighbors, or the general public if the container is left accessible. NorthPoint's containers remain NorthPoint's property at all times during the rental (see Section 12); Customer is responsible for taking reasonable precautions to secure the container against unauthorized use.
7. Weight Limits & Overage Fees
Each container size includes a weight allowance in the base rental price. Every container is weighed at the disposal facility. Loads exceeding the included allowance are billed at the per-pound overage rate below rather than rejected outright. Regardless of the rate charged, no container may be loaded beyond its Absolute Load Limit — loads at or above that limit pose a safety and legal roadworthiness risk and will require debris removal on-site, at Customer's expense, before the container can be transported.
- 10-Yard Dumpster: 1 ton (2,000 lb) included · $0.10/lb over allowance · Absolute Load Limit: 6,000 lb
- 15-Yard Dumpster: 1.5 tons (3,000 lb) included · $0.10/lb over allowance · Absolute Load Limit: 7,000 lb
- 20-Yard Dumpster: 2 tons (4,000 lb) included · $0.10/lb over allowance · Absolute Load Limit: 8,000 lb
Your confirmed weight allowance and rate are also shown at booking. NorthPoint will make reasonable efforts to notify Customer before charging an overage exceeding $500 on a single container, but is not required to obtain approval before charging any confirmed overage.
8. Prohibited & Restricted Materials
Title to and liability for any Prohibited Material remain with Customer at all times, even after placement in a NorthPoint container. NorthPoint has the right, but not the obligation, to inspect, analyze, refuse, or reject any load, in whole or in part, that it reasonably believes contains Prohibited Material.
Lithium-Ion Batteries
Lithium-ion batteries and lithium-ion battery-powered devices (tools, e-bikes, laptops, phones, vapes, and similar items) are strictly prohibited in any NorthPoint container. Under NH RSA 149-M:27, II, lithium-ion batteries must be recycled, not landfilled, and they pose a fire and explosion risk when crushed or compacted during collection and transport. Customer must remove all such batteries and battery-powered devices from any material placed in the container.
Other Prohibited Items
Prohibited items also include, without limitation: liquids, solvents, chemicals, Freon, non-lithium batteries, wet or unopened paint cans, biohazards and medical waste, asbestos, lead-painted materials, dirt/fill material, and equipment or containers holding gasoline, oil, or other fuel.
Restricted / Fee-Based Items
Restrictions and additional fees may apply to appliances, furniture, refrigerators, freezers, air conditioners, box springs, mattresses, hot tubs, propane tanks (of any size), televisions and monitors, computers, and tires (with or without rims). Indemnification for Prohibited Material
Customer agrees to defend, indemnify, and hold harmless NorthPoint, its owners, employees, and agents from and against any and all damages, penalties, fines, disposal-facility rejection costs, remediation costs, and other liabilities resulting from or arising out of Prohibited Material placed in a NorthPoint container, whether or not disclosed at booking.
9. Additional Fees & Charges
Depending on the circumstances of a rental, the following fees may apply in addition to the base rental price and any weight overage:
- Trip fee — return visit required due to blocked or inaccessible delivery/pickup location
- Wait-time fee — $2 per minute after the first 10 minutes on-site
- Dig-out fee — clearing snow, debris, or other obstruction to place or retrieve a container
- Overload fee — load exceeds the fill line or requires on-site adjustment before pickup
- Move charge — relocating a container at Customer's request after initial placement
- Dry run / failed access fee — driver dispatched but unable to complete delivery or pickup through no fault of NorthPoint
- Tow fee — at market rate, if a container or vehicle must be extracted or towed due to site conditions
- Restricted-item fees — per Section 8, for restricted or fee-based items disposed of in the container
Where NorthPoint's own cost is passed through directly (for example, a disposal-facility surcharge), NorthPoint will provide a copy of the relevant scale ticket or invoice upon request.
10. Cancellations & Rescheduling
To cancel or reschedule a confirmed booking, contact NorthPoint as soon as possible. The following cancellation fees apply based on notice given:
- More than 24 hours before scheduled delivery: no cancellation fee
- Within 24 hours of scheduled delivery, before the driver is dispatched: $50 cancellation fee
- After the driver has been dispatched or is en route: $150 cancellation fee, of which the trip/travel portion is non-refundable
Cancellation fees may be applied to the card on file or credited toward a future order at NorthPoint's discretion. Any difference between fees charged and services actually rendered will be refunded or applied as credit toward a future order.
11. Permits & Approvals
Customer is solely responsible for securing any permits or approvals required for container placement, including from Customer's municipality or, where applicable, an HOA — particularly for placement on a public street rather than a private driveway. NorthPoint is glad to deliver wherever works best for Customer's project, but confirming the right permissions are in place before delivery is Customer's responsibility.
Customer agrees to indemnify NorthPoint for any fines, tickets, towing charges, or other penalties imposed on NorthPoint as a result of container placement at a location Customer directed without required permits or approvals.
12. Equipment Ownership & Care
Each container delivered to Customer remains the property of NorthPoint at all times. Customer must take reasonable care of the container for the duration of the rental. Customer may not move, modify, paint, or alter a container. Any damage to, loss of, or unauthorized movement of a container will be charged to Customer at NorthPoint's cost to repair or, if necessary, replace the unit.
Customer is responsible for keeping the container reasonably secure until NorthPoint's scheduled pickup. Leaving a site unattended does not excuse Customer's responsibility or liability for contamination, overages, theft, or damage that occurs while the container is on-site.
13. Property Damage
Normal wear from a careful, properly placed delivery is not Customer's responsibility. Damage caused by Customer's own loading practices, movement of the container, or conditions at the requested placement location (including a soft, unstable, or undisclosed-hazard surface) may result in repair charges billed to Customer at NorthPoint's actual repair cost.
Customer must report any claimed property damage to NorthPoint in writing within 48 hours of discovery. Claims reported after this window may be denied for lack of ability to verify cause.
14. Theft, Vandalism & Fire
If a container is damaged by theft, vandalism, or fire while in Customer's possession, Customer must notify NorthPoint right away. Reasonable precautions on Customer's part — such as not leaving valuable materials visibly loaded, or securing the area if a container sits overnight before use — can help avoid disputes over responsibility for resulting costs. If a container itself is stolen or destroyed beyond repair while in Customer's possession, Customer is responsible for its replacement cost unless the loss is solely attributable to NorthPoint's negligence.
15. Indemnification
To the maximum extent permitted by law, Customer agrees to defend, indemnify, and hold harmless NorthPoint and its owners, employees, and agents from and against any third-party claims, damages, injuries, wrongful death, penalties, fines, and reasonable attorneys' fees arising out of: (a) Customer's use, loading, or placement of a container; (b) Prohibited Material placed in a container, as described in Section 8; (c) Customer's failure to secure required permits or approvals, as described in Section 11; (d) unauthorized movement or use of a container by Customer or a third party Customer allowed access; and (e) any breach of this Agreement by Customer. This indemnification survives the end of the rental period.
16. Limitation of Liability
To the maximum extent permitted by law, NorthPoint's total liability for any claim arising from a rental — whether based on contract, warranty, negligence, or any other theory — is limited to the amount paid for that specific rental. In no event will NorthPoint be liable for indirect, incidental, consequential, or special damages, including lost profits or project delay costs, even if advised of the possibility of such damages.
This limitation does not apply to Customer's indemnification obligations under Sections 8, 11, and 15, or to damages arising from NorthPoint's gross negligence or willful misconduct. Any claim against NorthPoint arising from a rental must be brought within one year of the date of the alleged incident, or such claim is permanently barred, to the extent permitted by New Hampshire law.
17. Force Majeure / Reasonable Control
NorthPoint will make every reasonable effort to deliver and pick up containers as scheduled, but is not liable for delay or failure to perform caused by events beyond its reasonable control, including severe weather, natural disaster, labor strikes, disposal-facility closures, changes in law, or inhibited road access.
18. Default, Non-Payment & Remedies
If Customer fails to pay any amount when due, NorthPoint may, in addition to the remedies in Section 3: (a) decline to schedule further deliveries or pickups until the account is current; (b) retain possession of, or decline to release, any container or its contents until payment is received; and (c) pursue any lien, security interest, or other remedy available under New Hampshire law for unpaid rental, disposal, or service charges.
19. Dispute Resolution & Governing Law
This Agreement is governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Any legal action arising from this Agreement must be brought exclusively in the state or federal courts located in Grafton County, New Hampshire, and Customer consents to personal jurisdiction and venue there.
20. General Provisions
Severability
If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement
This Agreement, together with any documents it expressly incorporates (the Delivery Policy, Charge Account terms, and What Can & Can't Go In a Dumpster guide), constitutes the entire agreement between Customer and NorthPoint regarding the rental and supersedes any prior oral or written understanding. It may not be modified except in writing signed by an authorized NorthPoint representative or through an updated version of this page.
Assignment
NorthPoint may assign this Agreement, in whole or in part, to a successor entity or affiliate without Customer's consent. Customer may not assign this Agreement without NorthPoint's prior written consent.
Waiver
NorthPoint's failure to enforce any provision of this Agreement is not a waiver of its right to do so later.
Notices
NorthPoint may provide notices under this Agreement by email, text message, or through the ICAN customer portal, using the contact information Customer provided at booking. Notices to NorthPoint should be sent to the email or phone number listed below.
Insurance
NorthPoint does not provide insurance coverage for Customer's job site, materials, or the container's contents. Customer is encouraged to maintain its own property and liability insurance appropriate to the project.

21. Changes to These Terms
NorthPoint may update these Terms from time to time. The version in effect at the time of Customer's booking governs that rental. Material changes will be posted on this page with an updated effective date.
